Contractor Terms of Service

INDEPENDENT CONTRACTOR STATUS
Contractor is an independent contractor, not an employee, and is solely responsible for taxes, insurance, licensing, and compliance with applicable law.
SCOPE OF SERVICES
Contractor will provide trash bin placement and retrieval services, communicate route issues promptly, and complete assigned work by required deadlines.
EQUIPMENT
Contractor provides their own vehicle, phone, fuel, and any necessary equipment unless otherwise agreed.
SAFETY
Contractor will use safe lifting practices, obey traffic laws, wear appropriate visibility gear when necessary, and immediately report accidents or injuries.
CUSTOMER PROPERTY
Contractor will respect customer property and will not enter homes or secured areas without authorization.
CONFIDENTIALITY
Customer information, pricing, routes, and company procedures are confidential.
COMPENSATION
Compensation is communicated before work is accepted and may be per home, per route, or another agreed method. Contractor receives a Form 1099-NEC when applicable.
ASSUMPTION OF RISK
Contractor understands trash valet services involve physical labor and inherent risks, including lifting injuries, slips, falls, weather, insects, animals, vehicles, sharp objects, leaking trash, and uneven surfaces.
MEDICAL RESPONSIBILITY
Contractor is responsible for all medical expenses, lost wages, and health insurance.
NO WORKERS' COMPENSATION
Contractor understands they are not covered by workers' compensation, unemployment, or employee benefits through CanDraggerz.
RELEASE
Contractor releases CanDraggerz from claims arising from ordinary negligence, except where prohibited by law or involving gross negligence or intentional misconduct.
PHOTO, ROUTE & SERVICE DATA
Contractor acknowledges CanDraggerz's platform requires photo documentation of completed stops for proof-of-service. Contractor consents to the collection and use of photos, location data, and route-completion data for service verification, quality assurance, dispute resolution, and payment processing.
INSURANCE & LICENSING
Contractor represents that Contractor maintains any insurance, licenses, and permits required by law to perform the Services, and will provide proof upon request.
INDEMNIFICATION
Contractor agrees to indemnify and hold harmless CanDraggerz, its officers, and affiliates from claims, damages, or expenses (including reasonable attorney's fees) arising from Contractor's acts or omissions in performing the Services, except to the extent caused by CanDraggerz's gross negligence or intentional misconduct.
NO ASSIGNMENT
Contractor may not assign or subcontract their obligations under this Agreement without CanDraggerz's prior written consent.
NON-SOLICITATION
During the agreement and for 12 months after termination, Contractor shall not solicit CanDraggerz customers for competing services within 30 miles of New Hanover County.
TERMINATION
Either party may terminate this agreement at any time upon written notice.
ELECTRONIC SIGNATURE
By checking the box to agree, Contractor consents to conduct this transaction electronically and agrees that this electronic acceptance has the same legal effect as a handwritten signature.
ENTIRE AGREEMENT; SEVERABILITY; AMENDMENT
This is the entire agreement between the parties regarding its subject matter. If any provision is found unenforceable, the remaining provisions remain in effect. CanDraggerz may update these terms from time to time; continued provision of Services after an update constitutes acceptance of the revised terms.
GOVERNING LAW
North Carolina law governs this Agreement. Venue shall be New Hanover County, NC.
DISPUTE RESOLUTION
Disputes will first be attempted to be resolved informally; if unresolved, the parties agree to resolve the dispute through binding, individual arbitration (not as part of a class or representative action), except either party may bring an individual claim in small claims court.
